Attempted Murder of a Police Officer
State v. WA
It was alleged that the defendant attempted to murder a police officer by firing a rifle at a Broward sheriff deputy. The shot was fired at a deputy while the deputy was driving a marked police van. Thankfully, the deputy survived the attack because the bullet did not pierce the van door. Several witnesses gave a detailed description of the shooter and the vehicle that the suspect fled in. The defendant was arrested for his alleged involvement in two (2) other shootings; a rifle was found in his car that, by chance, happened to match the description of the car that fled the scene of the shooting.
The Defense
At trial, Mr. Molle argued that the police had charged the wrong man. He pointed out that the witnesses identified the shooter as a young man in his early twenties; Mr. Molle’s client was in his early forties. Although the car that the defendant owned was similar to the car that the witnesses said fled the scene of the shooting, Mr. Molle pointed out the commonality of the vehicle and the significant differences. Tactfully, Mr. Molle convinced the jury to not do what the police had done; which was to rush to judgment and use the evidence from the other shooting that the defendant was alleged to be involved in and use that evidence to say that he was the suspect who attempted to murder the deputy in this case.
