Cocaine Trafficking

State v. VJ

It was alleged that the defendant and a co-defendant conspired to traffic in cocaine. When the alleged drug deal went bad, it went real bad. A shootout occurred and gunshots were fired in a residential neighborhood. The police responded and the defendant was stopped driving his car near the scene of the shootout. A large amount of cocaine was found in the vehicle, the defendant’s fingerprints were on the package containing the cocaine, the defendant gave an incriminating recorded statement, and the co-defendant turned state’s witness and testified at trial against the defendant.

The Defense

At trial, Mr. Molle argued that his client was in the wrong place at the wrong time. He argued that his client was simply giving the co-defendant a ride to a friend’s house and was not aware that a drug deal was going to occur. Mr. Molle was able to explain away his client’s fingerprints being on the package containing cocaine and his client’s incriminating statement. As far as the co-defendant testifying against his client, Mr. Molle crucified him on the witness stand. The jury saw the truth; that the co-defendant was a criminal trying to save himself at the expense of an innocent man.
