It was alleged that the defendant went to the victim’s home to visit. According to the victim, she asked the defendant to leave. She claimed the defendant refused, locked her in her bedroom, and sexually battered her. DNA evidence confirmed that the defendant had sexual intercourse with the victim.
The Defense
At trial, Mr. Molle argued that his client had “consensual” sexual intercourse with the alleged victim. Witness after witness, Mr. Molle dissected and dismantled the prosecutor’s case. He pointed out that the Sexual Assault Treatment Report was inconsistent with a finding of sexual assault. He cross-examined the alleged victim and convinced the jury that she was not the victim that she claimed to be.
