Trial versus Plea Bargain
The reality is that most criminal cases resolve by way of a plea bargain.
But how do you get the best plea bargain possible?
The answer: By having a trial attorney represent you. More specifically, one who is known by the prosecutor to go forward with trial and win. That is how you get the best deal. You see, the prosecutors know the local defense attorneys. Some have not gone to trial in years. They are known as plea attorneys.
The problem is that when the prosecutor knows the defense attorney will not likely proceed to trial, they have no incentive to make a good plea offer. On the other hand, a few defense attorneys, like Paul Molle, are known to hold the prosecutors feet to the fire and make them prove their case to a jury.
